1. Services
AHA Construction provides residential and commercial construction, home building, remodeling, repairs, and related handyman services. The specific scope, materials, schedule, and price for any project will be defined in a separate written estimate, proposal, or contract ("Project Agreement"). These Terms supplement, but do not replace, any signed Project Agreement.
2. Estimates & Quotes
Estimates and quotes are provided based on the information available at the time and on a reasonable assessment of the work requested. They are valid for thirty (30) days unless otherwise stated. Actual costs may vary due to unforeseen site conditions, material price changes, hidden defects, or changes requested by you. Any such variations will be communicated and, where required, approved before additional work proceeds.
3. Contracts & Change Orders
Work over the value required by California law will be performed under a written home improvement contract. Any change to the agreed scope of work must be documented in a written change order signed by both parties, which may affect the price and completion timeline.
4. Payment
- Deposits and progress payments will be made according to the schedule set out in the Project Agreement, consistent with California Contractors State License Board (CSLB) limits on down payments.
- Invoices are due upon the terms stated. Late payments may incur reasonable interest or fees as permitted by law.
- Title to installed materials may remain with AHA Construction until payment is received in full.
5. Scheduling & Delays
We make reasonable efforts to meet agreed timelines. Completion dates are estimates and may be affected by weather, permitting, inspections, material availability, or other factors beyond our reasonable control. We are not liable for delays caused by such circumstances.
6. Permits & Compliance
Where required, AHA Construction will obtain or assist in obtaining the necessary permits, and all work will be performed in accordance with applicable local building codes and regulations. The client is responsible for disclosing any HOA rules, easements, or restrictions affecting the property.
7. Warranties
AHA Construction warrants its workmanship as described in your Project Agreement and as required by California law. Manufacturer warranties apply to supplied materials and products. This warranty does not cover damage resulting from normal wear, misuse, neglect, alterations by others, or events beyond our control.
8. Client Responsibilities
- Provide safe and reasonable access to the work site.
- Disclose known hazards, utility lines, and property conditions.
- Secure or remove valuables and fragile items from the work area.
- Obtain any approvals required from third parties or HOAs.
9. Limitation of Liability
To the fullest extent permitted by law, AHA Construction's total liability arising out of any project shall not exceed the amount paid for that project. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under California law.
10. Licensing & Insurance
AHA Construction Inc is a licensed and insured contractor. License and insurance information is available upon request. Information about contractors is also available from the California Contractors State License Board.
11. Intellectual Property
All content on ahahomebuilders.com, including text, images, logos, and designs, is the property of AHA Construction Inc and may not be reproduced without permission.
12. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be subject to the jurisdiction of the courts located in Kern County, California.
